German Wirehair Pointer Puppy/Dog Sales Contract                                                         Pet Only

This agreement is made and entered into this day _____day of ________________20__ by and between ________________________(seller), and __________________________(buyer), for the purpose of setting forth the terms and conditions of purchase by the Buyer of a purebred German Wirehair Pointer form the litter whelped on ______________________ out of _____________________________ and ________________________.  For $___________, the seller agrees to sell and the buyer agrees to purchase a female ___ male___ companion puppy from the litter described above subject to the following terms.

  1. Seller warrants that the above described puppy/dog is a purebred German Wirehair Pointer and registrable with the AKC and that limited_____ Full_____ registration papers have been provided to the Buyer as of the date of the completed purchase, together with a true copy of its pedigree.

  2. Seller warrants that the above described puppy/dog is in good health at the time Buyer assumes ownership and is free of any life threating genetic defects for a period not exceeding 24 months. Buyer agrees to have the puppy examined by a licensed Veterinarian with in two (2) days (not including weekends and holidays) of receipt of puppy/dog. If as a result of the examination, the veterinarian determines that the puppy/dog is not in good health with the exception of worms and parasites (as are common in puppies) or has been found to have a life threatening congenital defect, then the Buyer shall elect to keep the puppy/dog or return the puppy/dog for a replacement puppy/dog. If the Buyer shall elect to keep the puppy/dog Buyer shall assume all costs veterinarian or otherwise. If the Buyer elects to return the puppy, Buyer shall, within ten (10) days after the date of signing this contract, send the Seller by certified mail a written Veterinarian’s certificate stating that the puppy/dog was in ill health or has a life threatening congenital defect when it was examined. Upon receipt of said certificate, Buyer shall be obligated to return the puppy/dog to seller at Buyers expense. Upon receipt of said certificate, the seller shall be obligated to replace the puppy/dog with same color, sex value from next available litter, and further performance under this contract shall be null and void. All action taken to return the puppy/dog shall be done with the best interest of the puppy/dog in mind. The Seller reserves the right to request a second opinion regarding the health of puppy/dog from a Veterinarian of their choice before replacing puppy/dog.

  3. Seller warrants that the puppy/dog sold hereunder is progeny of animals x-rayed and certified clear of hip dysplasia. If said puppy/dog develops hip dysplasia within 24 months from date of birth, the Buyer may return the dog to Seller and will receive a replacement puppy/dog of like quality from the next available litter, or may keep the dog, which will be spayed or neutered and Seller will refund $_________. Hip dysplasia diagnosis must be confirmed by a Veterinarian of Seller’s choice. This does not cover dysplasia caused by injury, neglect, poor diet, or other environmental conditions. If Buyer chooses a replacement puppy/dog, Buyer and Seller shall make prompt arrangements within ten (10) days of receipt of certified letter and Veterinarian Certification for return of the puppy/dog sold herein to Sellers place of business. Buyer shall be responsible for taking good and reasonable care of the puppy/dog until Seller receives it. Costs and related expenses of returning the puppy/dog to seller shall be the obligation of the Buyer.

  4. Ownership of the puppy/dog will be transferred to the buyer for the sale price of $______ to be paid as follows: $______holding fee paid at the time of reserving puppy/dog with the balance of $_________ to be paid on or before the puppy/dog leaves the Sellers premises. If the balance is not paid by__________________, this Agreement shall be cancelled, and the Buyer forfeits the deposit given hereunder. The Seller reserves the right to refuse sale any time before the puppy/dog is signed over for any reason or no reason at all.

  5. If delivery is requested by Buyer, it is the duty of the buyer to arrange it, and the buyer shall be liable for any injury obtained during transport. Buyer is responsible for costs of crate, insurance during shipment if applicable, cost of freight charges, and health certificate. If seller must purchase crate prior to shipping, Buyer shall reimburse Seller in full for this cost.

  6. The Seller has determined that the puppy/dog is of “pet quality” and is not suitable for Breeding and therefore limited registration is provided.

  7. The Buyer shall not under any circumstances breed this puppy/dog. The Buyer shall alter the puppy/dog before the age of eighteen (18) months. Unless a written letter by Buyers Veterinarian is sent to Seller requesting an extension for altering later. If the Seller approves the extension the Buyer may not breed that puppy/dog. The Buyer will send written proof of altering to the Seller before the puppy/dog turns eighteen (18) months of age. If this section of the contract is breeched by the Buyer a $1000 penalty shall be imposed upon the buyer by the Seller. Once the fine is paid the Buyer will not be charged the Fine a second time.

  8. Puppy/dog will carry Kennel name.

  9. Buyer agrees that he/she is not acting as an agent in the purchase or this puppy/dog and that buyer will not sell this puppy/dog or its progeny to any agent, pet store, or guard dog business.

  10. Buyer agrees that if it becomes necessary to sell or otherwise dispose of this puppy/dog, Buyer will notify the Seller before taking such action so that the puppy/dog may, at the Seller’s option, be re-purchased by the Seller at half of the sale price minus holding fee. Upon notification, the Seller shall have fifteen (15) working days to exercise said re-purchase option. Exercise shall be notice in writing sent to Buyer.

  11. Buyer agrees that the puppy will reside at the home of the Buyer, have access to a fenced yard, not be chained or tethered, and will be provided with proper housing, a good quality diet, annual shots, and exercise. Buyer also agrees that this puppy/dog will not be used as a guard dog for any business. Buyer agrees that at least one basic obedience training course will be completed with the puppy/dog.

  12. This agreement is made and signed by both parties to ensure the well-being and protection of this puppy/dog. If the Buyer breaches any part of this Agreement, the Seller is released from any obligations under this Agreement.

If the Buyer has purchased breeding rights of said puppy/dog and puppy/dog is a male than the buyer agrees to allow the seller to use him for free stud service and if puppy/dog is female then Buyer agrees to allow the seller a second pick female puppy from the buyers first litter. Buyer also agrees that before said puppy/dog will be used for breeding buyer will have hips, elbows, and thyroid certified acceptable.

  8. Puppy/dog will carry Kennel name.

  9. Buyer agrees that he/she is not acting as an agent in the purchase or this puppy/dog and that buyer will not sell this puppy/dog or its progeny to any agent, pet store, or guard dog business.
